Mela Merchant Privacy Policy

This Privacy Policy describes how Mela Finance Inc. ("Mela," "we," "us," or "our") collects, uses, and shares information when you use the Mela Merchant mobile application and related services (the "Services"). Mela Merchant is the business-facing companion to the Mela consumer application, designed for merchants and their staff to accept payments, manage transactions, and operate their business accounts.

By using Mela Merchant you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Services.

1. Information We Collect

We collect the following categories of information:

Account and identity information provided when you register or sign in: business name, merchant identifier, legal business details, contact name, email, phone number, address, tax identifier, and authentication credentials.
Know Your Business (KYB) and verification data we collect to comply with anti-money-laundering and financial regulations, including identity documents and beneficial-owner information where applicable.
Transaction data generated through the Services: payment request amounts, tips, references, invoice numbers, order numbers, timestamps, status (pending, completed, failed, cancelled), branch, and notes you provide.
Customer-provided information that you enter when creating a payment request (for example, a customer's phone number or email) so that Mela can route payment requests and confirmations. You are responsible for having a lawful basis to provide this information.
Staff information for team members you add to your merchant account: name, contact details, and assigned roles or permissions.
Device and technical information such as device model, operating system, language, time zone, IP address, and crash or diagnostic data, collected automatically when you use the app.
Usage information: the screens you access, features you use, and timestamps of in-app actions, used to operate and improve the Services.

2. How We Use Your Information

We use the information we collect to:

Provide, operate, and maintain the Services, including authenticating you, processing payment requests, and displaying transaction history;
Verify merchant identity and comply with applicable KYB, anti-money-laundering, sanctions, and financial regulations;
Detect, investigate, and prevent fraud, unauthorized access, and other misuse;
Respond to your support requests and communicate with you about your account or changes to the Services;
Improve, personalize, and develop new features;
Comply with legal obligations and enforce our agreements.

3. How We Share Your Information

We do not sell your personal information. We share information only in the following circumstances:

With service providers who process data on our behalf (for example, cloud hosting, identity verification, analytics, payment processing, and customer support), subject to contractual obligations;
With financial partners and banks necessary to process and settle transactions initiated through the Services;
With the relevant counterparty, for example sharing limited transaction details with the Mela consumer whose payment you request;
For legal reasons, including to comply with applicable law, regulation, legal process, or governmental request, and to protect the rights, property, or safety of Mela, our users, or others;
In connection with a corporate transaction such as a merger, acquisition, financing, or sale of assets.

4. Data Security

We implement technical and organizational safeguards designed to protect your information, including encrypted secure storage of authentication tokens on your device, encrypted transport (TLS), and access controls on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

5. Data Retention

We retain personal information for as long as your merchant account is active and thereafter for the period required to comply with our legal, regulatory, tax, accounting, and audit obligations, or to resolve disputes and enforce our agreements.

6. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, delete, or port your personal information, and to object to or restrict certain processing. To exercise these rights, contact us at support@melafinance.com. We may need to verify your identity before acting on a request and may decline requests where we have a legal obligation to retain information.

7. Children

Mela Merchant is not directed to individuals under 18. We do not knowingly collect personal information from children.

8. International Transfers

Mela operates from the United States. If you use the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and other countries where we or our service providers operate. We use appropriate safeguards for such transfers where required by law.

9. Third-Party Services

The Services may interoperate with services operated by third parties (for example, app stores, SMS delivery, or authentication providers). Their processing of your information is governed by their own privacy policies.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons. When we do, we will update the effective date above and, where appropriate, notify you through the app or by email. Your continued use of the Services after the updated policy takes effect constitutes acceptance.
